Q&A – Owner vs Association Responsibilities

Q. Does the Association have to pay  $2,200 to replace wallpaper damaged by a leak?

A. The unit owner is responsible for the wallpaper. The Condominium Act provides a list of items that are not covered by the Association, making non-listed items the responsibility of the unit owner. Under F.S. section 718.111(11)(f), each party is responsible for taking care of damages to property they are legally responsible for without consideration of which party caused the event or damage. That means that the statute eliminates the theory of cause.
